What happens if a debtor ignores our enforcement notice?
Once our Notice of Enforcement expires, one of our highly experienced High Court Enforcement Agents will visit the debtor’s premises to execute the Writ and secure payment or assets.
How long does a High Court Writ of Control remain valid?
The Writ stays valid for 12 months from the date it is issued. If there is a payment arrangement in place, that validity extends for 12 months from the date of the last payment we receive.
Do you have to allow our Enforcement Agents into your property?
The right of entry depends entirely on whether the property is residential or commercial. Please contact us directly so we can give you specific guidance based on your situation.
What is the cost to transfer a CCJ to the High Court for enforcement?
We don’t charge a fee for the administrative transfer to the High Court. However, there are standard statutory fees totaling £168. This includes a £78 Court fee to issue the Writ of Control and a £75 + VAT “Compliance Fee” (which you only pay if enforcement is unsuccessful). When we are successful, these costs are recovered in full from the debtor, making the process cost-neutral for you.
What is our Notice of Enforcement, and how long does a debtor have to pay?
This is a statutory notice we are required to issue before visiting a debtor’s address. It gives the debtor a clear 7-day period to settle the debt (calculated to exclude the day of postage, delivery time, Sundays, and Bank Holidays).
What assets can our Enforcement Agents take to recover your debt?
While certain essential items are exempt, we generally target assets with significant resale value to satisfy the debt. If you have specific assets in mind for seizure, please talk to us for a detailed assessment.
